Following a trial heard over 4 days, CG has successfully obtained judgment for its #manufacturing client and dismissal of a £500,000 counterclaim together with Part 36 protected costs. 

The dispute arose following a breakdown of a commercial relationship between the claimant, a drinks canning and manufacturing company and the defendant, a wholesaler of drinks. The defendant defended the claim and advanced a counterclaim in the sum of £500,000 alleging a significant shortfall in cans and the supply of large quantities of defective cans.

Recorder Hinchcliffe KC dismissed the counterclaim in its entirety with Part 36 protected costs awarded in favour of our client at the Liverpool County Court.
